Proper management of agricultural land is essential to meet the sustainable development goals of the 2030 Agenda, the objectives of the EU Green Deal and those of the European Climate Pact. In addition, security requires ensuring the competitiveness of agricultural holdings and the resilience of local and regional food systems, which is why it is essential to protect a scarce and non-renewable resource such as agricultural land, as well as to ensure access to it for agri-food producers.

The purpose of the Galician Agricultural Land Recovery Law is to fight against the abandonment and underuse of land (there are more than 500,000 hectares of abandoned or underused agricultural land) and to manage a somewhat complex land ownership structure (with small and scattered plots belonging to owners who are mostly disconnected from the rural world).

At the same time, it aims to provide a sufficient territorial base for farms that need it, given that land is a scarce resource that must be protected and managed, taking into account that it has a strong demand and that the agricultural sector is key in Galicia.

On the other hand, this law aims to anticipate fires and ultimately work towards demographic recovery and improving the quality of life of the population in rural areas.

Objectives

The Galician Agricultural Land Recovery Law aims to maintain and increase agroforestry activity and management by recovering abandoned lands, contributing to food security, facilitating access to land, improving the quality of life and preventing farms from closing or being abandoned in order to increase the territorial base.

Specific objectives:

  • Mobilize 512,308 hectares.
  • In the agricultural sector:
    • Generate a total standard production (PET) of 611.3 M euros and a gross added value (GAV) of 342.7 M euros.
    • Generate 9,168 jobs.
  • In the Galician economy:
    • Generate a turnover of 1053.5 million euros and a GVA of 482.9 million euros.
    • Generate 15,387 jobs.

Process followed for its launch

The Law on the Recovery of Agricultural Land in Galicia is part of a legislative body that culminates a path that was already noted in the explanatory memorandum of Law 4/2015, of June 17, on the improvement of the agricultural territorial structure of Galicia, when the need to implement instruments capable of guaranteeing compliance with the objective of improving the quality of life in rural areas was pointed out [...] by providing a set of its own legal rules [...] to constitute a coherent and effective legal body towards the contribution of the agricultural space and its production systems to this objective [...].

Law 4/2015, of 17 June, on the improvement of the territorial structure of agricultural holdings in Galicia, has as its declared objective the action in those areas in which it is possible to improve the territorial structure of agricultural holdings; it is not, therefore, applicable in areas in a situation of abandonment, in which there are no holdings. On the contrary, these abandoned areas are the main objective of the recovery figures, which even have, within their procedures, the possibility of carrying out parcel restructuring in the recovered areas. Furthermore, the law declares as priority areas for the development of agroforestry estates of public initiative the areas of concentration or parcel restructuring completed that present an abandonment of more than 50% of their area. In this way, the relationship between productive recovery and parcel restructuring is not only not competitive, but is synergistic and complementary.

This law also responds to the will to comply with the parliamentary mandate contained in the Opinion of the Special Non-Permanent Commission for the Study and Analysis of the Reforms of Forestry Policy, Prevention and Extinction of Forest Fires and the Galician Forestry Plan, of July 31, 2018, of the Parliament of Galicia, because it includes throughout its articles, specifically, 43 of its recommendations.
